Sarasota Car Accident Lawyers

Car accidents are terrifying. The aftermath of an accident can be just as terrifying and even more confusing. Car accidents happen unexpectedly, no matter how safe of a driver you may be. There are always drivers on the road who are careless and who have the potential to cause serious accidents. Even though you may not be at fault, you may still be left with serious injuries and medical expenses, and an insurance company that does not want to pay for those claims. The insurance company begins its investigation as soon as the accident is first reported to them with the hope of limiting the amount of your recovery on behalf of their insured. If you do not hire an experienced car accident attorney, you are alone and inexperienced, battling insurance adjusters to decide how to obtain and pay for necessary medical treatment. How do you begin to evaluate your claim for damages, injuries, harms and losses?

Sarasota Slip & Fall and Premises Liability Lawyers

Property owners and managers are required by law to maintain buildings and premises in a reasonably safe manner. This means that the owner must:

  • Comply with local building codes and other requirements
  • Fix any issues that pose a safety hazard
  • Remove or otherwise address hazards within a reasonable time
  • Warn guests of potential dangers
  • Install safety equipment where necessary
  • Provide adequate security
  • Train employees to act in a safe manner

If the responsible party fails to do any of the above and someone is injured, they are required to pay compensation to the victim. Whether it’s a slip-and-fall in the fruit aisle of the grocery store, a head injury from falling debris, or a broken ankle from stepping in a hole in a neighbor’s yard, injuries caused by unsafe conditions result in trips to the emergency room and lost wages.

How will the negligent party be held accountable?” Answers to such questions may come through a wrongful death claim or lawsuit.

Florida Workers’ Compensation Law

Florida Workers’ Compensation Law entitles each injured employee to receive two-thirds (2/3) of their gross wages, up to the statutory maximum, until that employee reaches maximum medical improvement (MMI). Once maximum medical improvement (MMI) is reached, the employee can then receive impairment income benefits, which are based on the permanent impairment rating from the employee’s treating physician. In addition, all authorized medical bills and prescriptions will be paid by the employer’s insurance carrier.

Under Florida law, employers are required to provide a safe working environment for all staff members. However, it is inevitable that injuries may occur from slipping and falling, improper safety equipment, improper maintenance or carelessness of fellow employees. It is important to understand that workers’ compensation benefits are provided to the employee regardless of who is at fault for the injury as long as the injury occurred during the course and scope of the employee’s job.

Social Security Disability Attorneys

The law defines disability as the inability to engage in any substantial gainful activity by reason of any medically determinable physical or mental impairment(s) which can be expected to result in death or which has lasted or can be expected to last for a continuous period of not less than 12 months.  A person is considered disabled under the Social Security Act if they can’t work due to a severe medical condition that has lasted, or is expected to last, at least one year or result in death. The person’s medical condition(s) must prevent them from doing work that they did in the past, and it must prevent them from adjusting to other work.

Sarasota Pedestrian Accident Lawyers You Can Trust

Pedestrian accidents stand out from other traffic accidents for a number of reasons:

  • A human body is no match for a car, truck, or motorcycle in motion. The person struck has no vehicle body surrounding him or her and no protective devices such as seat belts. A pedestrian with a helmet is a rarity. Head injuries and other serious injuries are common.
  • Sometimes, pedestrian accidents are truly accidents. This can be the case when motorists could not see the person or tried unsuccessfully to avoid striking him or her. In other cases, a pedestrian accident is clearly the result of gross negligence by a driver.
  • Hit-and-run pedestrian accidents are common. Even if the vehicle or driver is never identified, there may be other available sources of compensation, such as the pedestrian’s own uninsured motorist coverage (or that of a close family member living in the same residence).

Every accident is unique. Variables such as crosswalks, crossing signals, and the injured pedestrian’s age may have an impact on a pedestrian accident case.

Sarasota Boating Accident Attorneys

Boating accidents, much like car crashes, come in many varieties: boats crash into docks and other boats, for example. Boating accidents may involve other types of vessels or vehicles, such as personal watercraft and kayaks. Tour boats, tugboats, and ferries may be involved in major accidents that injure multiple people. There have been cases of passengers falling overboard, collisions with swimmers or skiers, and even boats tipping over because of load imbalances. Motorized boats traveling at high speeds are naturally prone to crashes, but slow-going vessels like canoes may also cause accidents leading to injuries and even deaths.

Insurance Disputes & Bad Faith Lawyers

Often, after someone experiences an injury or property damage due to an accident, you will hear the words “this is what insurance is for.” People pay insurance premiums for their homes, vehicles, health and disability and, in turn, expect to be covered when an accident or incident occurs that could potentially cause financial ruin. We all like to assume that the insurance company will put our best interests above their financial profit. Unfortunately for many people, the peace of mind that they believe their monthly premiums afford them can be taken away by an insurance company that does not act to protect their interests.
