Our client was initially represented for her May 2022 accident date by another firm that filed suit on her behalf in March 2023.  Once we were brought on the case, we immediately went to work on the case with depositions and demanded the insurance policy limits. Within three months of hiring our firm, our office secured a policy limits recovery for our client that will provide for her future medical needs.

Our client was involved in a terrible motorcycle accident on I-75 on his way to work early one morning. He suffered cracked ribs, a broken collar bone, and a fractured ankle, which required emergency surgery.  The driver of the at-fault vehicle fled the scene of the accident, and despite an extensive search by our office using a private investigator, he was never located. However, our office pursued the insurance that was available through the vehicle owner’s policy as well as the stacked underinsured motorist coverage that our client had in order to maximize the amount that he could recover. Fortunately, we were able to resolve the case shortly after the accident, negotiate medical bills for our client, and provide peace of mind for our client for continued recovery. 

Our client was driving a van for his employer when he was rear-ended at a high rate of speed. The at-fault driver did not have any Bodily Injury insurance. This left the uninsured motorist coverage through the employer as the only option for compensation for the injuries that he sustained. Our client had a left shoulder injury that required surgery, as well as back, neck, and facial injuries. After attempts to resolve his case broke down, our client filed a lawsuit against the insurance company. After extensive litigation and depositions, the insurance company finally caved and settled the case for its true value.

Our client was riding his bicycle, as he routinely does, when he was struck by the defendant driver in a roundabout.  The Bodily Injury insurance company quickly tendered their minimal policy limits, but that did not compensate our client for his severe injuries.  His fractured clavicle, injured shoulder, and lower back pain impacted his daily life significantly, especially his ability to ride his bike and exercise.  The underinsured motorist coverage presented an initial offer of $9,000.  After months of negotiations and litigation, our office settled the case for more than 13x the original offer. 

A sister and brother, both college students, were driving together when another vehicle failed to stop at a red light and crashed directly into the passenger side of the vehicle. Our clients were both injured in the accident, with the brother sustaining a serious head injury. Our office worked with both of our clients and their parents to ensure that they received the proper treatment for their injuries.  Our team sent an offer to the bodily injury insurance company, as well as, the uninsured/underinsured motorist insurance carrier to secure the best possible settlement for both client. We were able to maximize the settlement amount and negotiate the medical bills so that both clients received the maximum settlement proceeds.

Our client was the 21 year old passenger in his friend’s vehicle when the driver failed to negotiate a turn at a high rate of speed and collided with a tree. Our client was transported to the trauma unit of the local hospital and had multiple surgeries for his severe injuries. He sustained traumatic head injuries as well as severe abdominal injuries which required a colostomy bag for an extended period of time.  Needless to say that this accident had a profound impact on his young life. After several years of surgeries and healing, our client was able to achieve a good recovery and return to a normal life. After filing suit and a year of litigation, Mr. Linehan was able to negotiate a settlement from the bodily injury insurance company, as well as, the umbrella liability insurance company.

A 21-year-old was sitting on the curb at a bus stop at a busy intersection in Venice when the defendant driver attempted an evasive maneuver to avoid traffic that was stopped at a red light. The defendant was driving a large commercial tree trimming truck with a wood chipper attached via trailer. Due to his failure to use due care and begin braking at a safe distance, he had to swerve across several lanes of traffic eventually ending up in the right-hand turn lane, driving up onto the curb and over our client. Our client was left with crush injuries to the lower half of his body and had to undergo over 14 surgical procedures in a two-month time period.

Additionally, he had severe injuries to his bladder which needed multiple surgeries and lead to long-term usage of a catheter, bladder and UTI infections, and ongoing urinary issues. He spent a little over a month in the hospital and then another month in an extensive rehabilitation facility. He has recovered well but will require extensive future care for all of the hardware that is in his body as well as extensive pain management due to the injuries. Our office was brought in within days of the accident to help our client’s mother negotiate the difficult process of managing his treatment needs as well as making sure that those needs are paid for by the responsible party.

The defendant tree trimming company hired an attorney within days of the accident in order to minimize their damages. They began investigating the possibility that there was a brake failure. Our office sent a demand to the insurance company and when they didn’t respond to the demand within the allotted time, we filed suit on behalf of our client.

After over a year of litigating the claim, the defendant tree trimming company decided to accept our settlement offer of $4,200,000 which allowed our client to pay for his past medical care as well as have the necessary funds for his future care needs. Injuries: Numerous and extensive orthopedic injuries consisting of fractures of both superior and both inferior pubic rami, pelvic ring fractures, right subtrochanteric femur fracture, left intertrochanteric femur fracture, and bilateral pelvic fracture. Numerous surgical procedures to repair the fractures with hardware both internal fixation and external fixation, debridements and irrigations of right and left thigh and buttocks wounds, closure of right and left thigh and buttock wounds, skin grafts, extensive bladder surgeries including bladder and urethra reconstruction. Chronic pain syndrome and placement of a pain pump.

Damages: Past and future medical care, future loss of earning capacity, past and future pain and suffering. 

Our client was enjoying a ride on his motorcycle when he was struck by the Defendant driver. He was immediately airlifted to a trauma unit in Tampa due to his extensive injuries. Our office sent offers to both the Defendant’s insurer as well as our client’s uninsured/underinsured motorist insurer for their policy limits ($1,000,000 and $500,000 respectively). Both insurance companies accepted our offer and within months of the accident, our office secured a full settlement for our client.

Injuries: comminuted fracture of the right iliac wing and fracture of the right acetabulum, a fracture of the left sacrum, a fracture of the left and right superior pubic ramus with a fracture line extending into the pubic symphysis, multiple fractures of the right foot, right humerus fracture, right femur fracture, right tibia & fibula fractures, left wrist fracture, right ankle fracture. Some of the fractures required surgery with internal fixation and permanent fixtures as well as extensive physical therapy.

Damages: Past and future medical expenses, pain and suffering, past and future lost wages.

Our client, John Doe, was riding his motorcycle on Placida Road in Charlotte County, when a vehicle turned in front of him causing the crash.  Mr. Doe sustained serious injuries and was taken to a trauma facility for the treatment of his injuries.  He underwent multiple emergency surgical procedures to repair fractures in both of his legs and his pelvis, in addition to several non-emergent surgical procedures in the subsequent months.  Mr. Doe had a lengthy healing period and endured months of therapy to be able to walk on his own again.  Our office went to work on Mr. Doe’s case right away, contacting the insurance company and providing them with multiple chances to settle the case for the policy limits of $500,000. 

The Defendant’s insurance company did not make any counteroffer or attempt to settle the case until after our office filed suit against them.  After a litigation period and two mediations, the insurance company finally agreed to settle for $1,000,000 plus the property damage of $13,791.85, which was $513,791.85 over the policy limits.

Had the insurance company responded to our offer in a timely manner, they would have saved themselves the expenses associated with litigation and the additional amount over the policy limits that they ended up having to pay.

Our client and his friend were on their way home after celebrating St. Patrick’s Day at a local bar. While stopped at a light, his friend’s truck was struck from behind by a minor driver. After the crash, both our client and the driver exited the vehicle to assess the damage. At that time, the minor driver restarted his vehicle, drove onto the sidewalk, and struck our client throwing him in the air and severely injuring him.

The minor driver was caught a few blocks away and was arrested for leaving the scene of an accident as well as for drunk driving. Travis was transported via Bayflight and then endured months of surgeries and rehab on his knee, eventually requiring a total knee replacement. An offer was sent to the UM carrier of the vehicle that our client was in as well as to the owner of the defendant’s vehicle. Our office secured settlements from the UM as well as from the owner of the vehicle for the initial crash. The liability insurance company denied our client’s offer to settle and suit was filed.

After several years of litigation, our office took this case to trial, and the judge and jury returned a verdict of $578,301.

Auto Negligence/Punitive Damages; Injuries: closed head injury, leg injuries requiring multiple surgeries and total knee replacement, low back injury, and continual neck pain.

Our 22-year-old client was driving home in the early morning hours on US-41 when the defendant driver going in the opposite direction crossed the center line and struck her car head-on. She was transported to Sarasota Memorial Hospital and then later airlifted to a trauma hospital where she underwent emergency surgery for a pelvic fracture. The defendant was arrested for DUI and tested positive for both alcohol and marijuana.

Our office sent settlement offers to both the driver and owner of the vehicle and when neither responded within the time limits, we filed suit against both parties. After extensive litigation, our office secured a settlement for our client of $550,000.

Injuries: Fractured pelvis requiring internal fixation with 6 screws and a plate, both knees, low back.

Damages: Past and future medical care, past lost wages, past and future pain and suffering. 

Our client was riding his motorcycle to work at his furniture company when the defendant driver turned in front of him, violating his right of way and severely injuring him. Due to his injuries, he was subjected to numerous surgeries over the course of a year as well as countless months of rehabilitation and physical therapy. Since he was unable to work in his furniture business, he not only had to hire additional employees to complete the projects that were outstanding, but he also had to turn down projects that there was no way to complete. This cost his company and himself significant amounts of income. The Defendant Cable Company agreed to settle for $500,000 at mediation.

Injuries: cuts and scratches requiring stitches, back injuries resulting in continual pain, compound leg fracture requiring surgery, knee injury requiring multiple surgeries.

 Our client was a passenger on her boyfriend’s motorcycle when he was involved in a T-bone accident resulting in catastrophic and significant injuries.  She sustained severe lower extremity injuries which resulted in numerous surgeries, wound-healing devices, and an extended stay in a rehabilitation facility.  After extensive litigation with the defendant’s insurance company, our client received a $2.3 million settlement offer.

Our client was involved in a motorcycle accident in Englewood FL where an at-fault driver turned in front of him. He sustained severe and significant injuries requiring lengthy hospitalization and rehabilitation. The insurance company paid 10 times the policy amount of $100k.

Our client was riding his motorcycle when an at-fault driver turned left directly into him. This caused debilitating orthopedic injuries that will likely result in lifelong impact for our client.  The defendant’s insurance company used its typical delay tactics to attempt to discourage our client from continuing to pursue his claims.  They hired experts to provide the opinion that our client was partially at fault in the accident due to speed and that there were other factors on the roadway that made it difficult for their client to see the motorcycle as it approached. 

Our office filed suit, hired our own experts, and aggressively fought the insurance company for our client. We were able to secure a satisfactory settlement for him just weeks before the trial was to occur.

As a pedestrian, our client was struck by a pick-up truck in the parking lot of an Englewood Shopping Plaza, sustaining significant injuries and requiring multiple surgeries and physical therapy.
